**Subject:** DEMURRAGE DISPUTE — MT EUROPA STAR — VOYAGE 2026-Fos-Singapore-005 — USD 58,000 claimed, despatch USD 38,666.67 owing + TIME BAR CHALLENGE **To:** Tsakos Energy Navigation Ltd. Demurrage Department Athens, Greece **From:** BP Singapore Pte Ltd. Marine Operations Reference: BPSG-DEM-2026-005 **Date:** 28 May 2026 --- Dear Sirs, We refer to your demurrage invoice dated [date], claim sum **USD 58,000.00**, in respect of voyage 2026-Fos-Singapore-005 (MT EUROPA STAR, EN590 ULSD gasoil, Fos-sur-Mer→Singapore, BPVoy 4 form). We have completed an independent audit and respectfully dispute the claim. The vessel was entitled to **despatch USD 38,666.67**, producing a net amount **due to Charterer of USD 96,666.67**. In addition, we **specifically raise the BPVoy 4 time-bar clause** (Clause 20) — see Section 3 below. ## 1. Engine calculation - **Laytime allowed:** 84.00 h (BPVoy 4 + SHINC + 6h turn time per CP Part I) - **Laytime used:** 25.00 h (per SoF events) - **Delta:** -59.00 h - **Despatch rate:** USD 16,000/day × 59 h = **USD 38,666.67 owing to Charterer** ## 2. Total Terminal efficient turnaround Vessel berthed Berth 12 (Total Terminal) at 06:00 UTC 21 April 2026, loading commenced 08:00, completed 10:00 UTC 22 April — 26 hours laden including pump priming. Despatch clearly crystallised. ## 3. BPVoy 4 time-bar challenge Per **BPVoy 4 Clause 20** (incorporated by reference), a demurrage claim must be presented to Charterer within **30 days from completion of discharge** **together with all supporting documents**: NOR, SoF (signed by both parties), pumping logs, time logs, laytime calculation, and demand letter. Per the **DEMURRAGE_TIME_BAR_FORM_VARIATIONS rule** and **INVOICE_PRESENTATION_REQUIREMENTS rule** in our engine (sources: Schofield §7.10-7.30, Cooke Ch. 17, BIMCO comparison, *The Amalie Essberger* [2019] EWHC 3402, and ASDEM issue 27): a. Strict construction applies — late presentation = **absolute forfeiture, no cure**. b. Some BPVoy 4 amendments require **actual receipt** by Charterer (not merely "sent"). c. Partial submission of documents within the 30-day window may still bar the entire claim. d. The pumping log production is itself a condition precedent under BPVoy 4 Clause 19. Please confirm by return: 1. **Date of completion of discharge** at Singapore (Charterer's records show [date]); 2. **Date your demurrage invoice was actually received** by BP Singapore (we have searched our records and have no record matching the 30-day window); 3. **Production of the fully signed pumping log** per Clause 19. Absent satisfactory confirmation on points 1-3, the claim is time-barred and we reserve the right to plead Clause 20 as a **complete defence** in any subsequent arbitration. ## 4. Applicable authorities - **BPVoy 4 Clauses 19, 20, 30** (pumping log, time bar, arbitration) - **The Amalie Essberger** [2019] EWHC 3402 (strict construction of time-bar clauses) - **Schofield "Laytime and Demurrage" 8th ed** §7.10-7.30 - **Cooke "Voyage Charters" 5th ed** Ch. 17 ## 5. Demand We demand: 1. **Withdrawal** of the USD 58,000 invoice; 2. **Confirmation** of points 1-3 in Section 3 above within 7 days; and 3. **Payment** to Charterer of despatch **USD 38,666.67** within fourteen (14) days from this letter. ## 6. Reservation of rights All Charterer's rights expressly reserved including the BPVoy 4 Clause 20 time-bar plea. Yours faithfully, **BP Singapore Pte Ltd.** Enclosures: Annex A (Demurrage.IA audit PDF, 5 pages); Annex B (rules dossier — time-bar form variations); Annex C (citations CSV).

Analyst notes (58)
Engine flags each clause needing customer review. First 5 shown below.
- CANCELLATION_CLAUSE: customer verify laycan window em CP. Laydays = earliest NOR; cancelling date = latest arrival before charterer pode cancel. Vessel early: charterer pode delay laytime start. Vessel late: charterer cancels sem liability. Owner improper cancellation: damages for market loss (ballast + freight). BIMCO Cancelling Clause 2002 standard.
- LAYCAN_RIDER_EXTENSION: customer verify rider clauses. "Slip laycan" permits N-day extension via mutual consent. "Firm laycan" no slippage. "Substitute laycan" entire window replaced. LATAM CPs (Synacomex/Norgrain): laycan tied to grain elevator availability. Brazilian iron ore: mining production schedule. Argentine grain: Up-River elevator. Mutual consent required (no unilateral). Addenda document changes.
- NOR_VALIDITY_BASIC is draft-pre-sme: does not check WIPON/WIBON/WIFPON/WCCON, free pratique, customs, pumping readiness
- NOR_NOTIFICATION_METHOD: customer verify CP notification method clause. Asbatankvoy Cl. 6: telex/written. BPVoy 3: fax confirmed by telex. Modern CPs: email increasingly accepted. Default English law: any reasonable method. The Port Russell: enumerated list = exhaustive (closed). Recipient: charterer ou authorised agent (não pilot/port authority/terminal). Waiver via subsequent action sem protest cures defect.
- ANTI_TECHNICALITY_CLAUSE: customer verify CP. NYPE 2015 cl. 11(b) standard 3 banking days cure. BIMCO Anti-Technicality 2002 standard. Three notice elements required: (1) identify default; (2) state cure period; (3) warn of withdrawal. The Afovos [1983]: premature notice invalid. The Li Hai [2005]: clear banking days computation excluding day of notice. The Nanfri: bona fide deductions bar withdrawal. Cannot validate fundamentally bad NOR — só minor defects.

Why charterers + tribunals trust this output
- CP#3 — Deterministic engine. Pure TypeScript, zero LLM in the calc path. Same input = same output, always.
- CP#4 — Citation chain. Every fact in every output traces to a verbatim quote + page + paragraph in the source CP/SoF.
- CP#5 v2 — Multi-source validation. Each rule backed by ≥7 sources (Schofield, Cooke, BIMCO clauses, LMAA awards) + multi-model AI agreement.
- CP#8 — Data ownership. Your CPs and SoFs are yours. Export anytime, delete on churn.
